1. Agreement
By accessing the CyberAIX website or using any CyberAIX service that is not covered by a separately signed agreement, you agree to these terms. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization. Customers with a signed service agreement are governed by that agreement where it conflicts with these terms.
2. The service
CyberAIX provides software for collecting, transforming, routing, and searching telemetry data. We may modify, suspend, or discontinue features from time to time. Where a change materially reduces functionality for paying customers, we will provide reasonable notice.
3. Accounts and access
You are responsible for maintaining the confidentiality of credentials and for all activity under your account. Notify us promptly of any unauthorized use. You must provide accurate information and keep it current.
4. Acceptable use
You agree not to:
- Use the service to violate any law or the rights of others.
- Attempt to gain unauthorized access to the service, other accounts, or connected systems.
- Interfere with the operation or security of the service.
- Reverse engineer, copy, or resell the service except as expressly permitted.
- Upload content that is unlawful, infringing, or malicious.
5. Customer data
You retain all rights to data you submit to the service. You grant CyberAIX a limited license to process that data solely to provide and support the service. You are responsible for having the necessary rights and consents to submit the data and for configuring the service, including retention and routing, in accordance with your obligations.
6. Intellectual property
The service, including software, documentation, and content on this site, is owned by CyberAIX or its licensors and protected by intellectual property laws. These terms grant no rights except as expressly stated. Feedback you provide may be used by CyberAIX without obligation.
7. Fees
Paid services are subject to the fees and payment terms in the applicable order. Fees are exclusive of taxes unless stated otherwise. Late payments may result in suspension after notice.
8. Confidentiality
Each party will protect the other's non-public information with reasonable care and use it only as needed to perform under these terms, subject to standard exceptions for information that is public, independently developed, or required to be disclosed by law.
9. Disclaimers
The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, CyberAIX disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. CyberAIX does not warrant that the service will be uninterrupted or error-free.
10. Limitation of liability
To the fullest extent permitted by law, CyberAIX will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from these terms or the service. CyberAIX's total liability for any claim will not exceed the amount you paid for the service in the twelve months before the claim arose, or one hundred US dollars if you have not paid anything.
11. Termination
You may stop using the service at any time. We may suspend or terminate access for breach of these terms after notice where practicable. Sections that by their nature should survive termination will survive.
12. Governing law and disputes
These terms are governed by the laws of the jurisdiction stated in your order or, absent an order, the jurisdiction in which CyberAIX is organized, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction unless the parties agree otherwise in writing.
13. General
These terms are the entire agreement between you and CyberAIX regarding the website and unsigned services. If any provision is unenforceable, the rest remains in effect. We may update these terms by posting a revised version with a new effective date; continued use after the change constitutes acceptance.
